IndusViva Is Returning To Direct Selling

After being certified as a valid business by the Indian courts, IndusViva has reverted to direct selling. After being labeled a pyramid scheme, the Network Marketing brand has been embroiled in a legal struggle for months.

According to reliable sources in the country, the Superior Court of Telangana accepted an order on the company’s petition for a court order, IA Nos. 1,2,4 and 6 DE 2021INWP NO: 5877 OF 2021, to unfreeze all bank accounts and not interfere with the organization’s daily operations on July 26, 2021.

What is IndusViva and what does it do?

IndusViva is a direct selling firm that was founded in 2014 under the Indian Companies Act 2013. Its business approach is direct selling.

Under license from the Department of Ayush, they make and market world-class Ayurvedic health-promoting goods.

In seven years, they generated total revenue of roughly INR 1450 crores, almost half of which was paid to direct sellers as commission for selling products and over 200 crores to the central and state governments as different taxes such as GST, rent tax, TDS, and so on.

The history of IndusViva

Many MLM organizations have been misunderstood for pyramid schemes, as has been the case with IndusViva. As a result of the confusion, it was placed on the radar of the authorities, and 24 persons associated with the company were arrested.

According to the organization, the Cyberabad Economic Crimes Wing of Telangana took this harsh measure after receiving an INR 12,500 complaint from a person that was compensated and addressed a year ago.

The Law gives its legality

IndusViva is not a chit prize and money circulation scheme, according to Section 2 of the Chit Prizes and Money Circulation (Banning) Act of 1978, because it meets all of the standards outlined in the 2016 Direct Selling Guidelines and the Selling Guidelines. Telangana is a state in the Indian state of Telangana.

A direct selling entity is defined as an entity that does not participate in a pyramid scheme and/or money circulation scheme but sells or offers to sell goods or services through direct sellers, according to the Consumer Protection Law of 2019.

According to reports, there is no solid policy or government climate in India that encourages direct marketing. Due to a lack of precise rules, many efficient qualities of direct selling enterprises are covered by the several regulations now in effect, resulting in definition confusion.

The Telangana government has proposed regulations for the direct selling industry. The ‘Telangana Direct Selling Guidelines Order 2017′ implements the Core Guidelines and gives the direct selling business more precision.

State governments have been urged to adopt guidelines to reinforce existing regulatory procedures on direct selling and multi-level marketing to combat fraud and defend consumers’ legitimate rights and interests.
