Proceedings for shutting down MLM company Vihaan Direct Selling initiated

The Registrar of Companies has conducted inspection into the accounts of the firm and have found various violations, fraudulent activities an intention to dupe investors.

Union Ministry of Corporate Affairs (MCA) has initiated proceedings for winding up the activities of Vihaan Direct Selling India Private Limited, the Indian franchise of Hongkong based MLM firm Qnet.

The ministry also issued Look out circulars against former world Billiards champion and Padma awardee Michael Fereira and eleven others who are associated with the company as directors and promoters.

Based on the cases registered by the Cyberabad police, the Registrar of Companies (ORC) has conducted inspection into the accounts of the firm and have found various violations and fraudulent activities with an intention to dupe investors.

Meanwhile, Cyberabad police appealed to the public not to join or make any further payments to Vihaan group or any firms operating MLM or ponzi schemes. “There are 38 cases and 70 persons associated with it are arrested in Cyberabad. There are cases in other parts of the country too. ROC has also found several violations during inspection of their account books,” Cyberbad police commissioner VC Sajjanar said.

Cyberabad police have already served notices to celebrities like Shahrukh Khan, Anil Kapoor, Boman Irani, Allu Sirish and several others in connection with their relation with Qnet and its franchises and they have sent their explanation through their advocates.

“They are being verified. Based on the outcome, the investigation will proceed,” said Sajjanar.

MCA also issued a public notice alerting the public about the activities of the group. “The Inspection report is uploaded on the website of the Department of consumer affairs for information of the general public with a view to make them aware so as to prevent any possible fraud by the company under the garb of direct selling and multi-level marketing (schemes),” it said in the notice.

The MCA has informed Cyberabad police that inspections were conducted by the ROC on the group under the provisions of the Companies Act. Prosecutions have been launched by the ROC and LOCs have been issued against 12 persons. The ROC has also filed a petition before the NCLT for winding up the company.

The Ministry also informed the victims that in the garb of direct selling and e-commerce businesses, the company has drained out more than Rs 20,000 crores out of India.

Inquiries further revealed that Qnet had been operating in India as Goldquest and Questnet, Pallava Resorts, but stopped activities after the intervention of regulatory agencies. The company also sold products to its members with a huge profit margin of 160 to 416 per cent. The balance sheet examination also revealed that the products sold by them are immaterial and they were running an illegal product-based pyramid scheme. Even while selling products, the company sold the same product to different persons on the same date with huge differences in price.

While a former techie Adapa Aravind associated with Qnet committed suicide allegedly incurring losses by investing in QNet, two more similar cases were reported at Chennai and Maharashtra, found Cyberabad police.

Meanwhile, Qnet in a release claimed that the Public Notice is premised on the purported report of the Registrar of Companies, Karnataka and it is fallacious and has been prepared without any merit basis and understanding of the business. “We have challenged the said report in the appropriate judicial forum.” it said.

The Registrar of Companies has no bearing to deal with the aspects of our compliance with the said Direct Selling Guidelines and therefore any comments in this respect are completely out of place and baseless.

Our distributors are not investors. “In fact, we have no investors in our business as alleged. We are fully legitimate and compliant as per Indian laws,” it said.

दिल्ली व्यक्ति गिरफ्तार। पोंजी स्कीम के साथ 500 से अधिक लोगों को धोखा दिया।

पुलिस ने कहा कि 37 वर्षीय एक व्यक्ति को विभिन्न लोगों को विभिन्न पोंजी योजनाओं में निवेश करने के लिए प्रेरित करके और करोड़ों रुपये का चूना लगाने के आरोप में शुक्रवार को गिरफ्तार किया गया था। अधिकारियों ने कहा कि पूछताछ में पता चला है कि आरोपी और उसके सहयोगियों ने लोगों को विभिन्न पोंजी योजनाओं में निवेश करने के लिए प्रेरित किया था और उनसे प्राप्त धन को हड़प लिया था।

आरोपियों की पहचान गाजियाबाद के रहने वाले संजीव कुमार के रूप में हुई।

वरिष्ठ पुलिस अधिकारी ओपी मिश्रा ने कहा, “पोंजी योजनाओं के जरिए धोखाधड़ी करने की शिकायत पिछले साल मिली थी और आरोपी को गाजियाबाद से गिरफ्तार किया गया था।” अधिकारियों ने कहा कि पूछताछ में पता चला है कि आरोपी और उसके सहयोगियों ने लोगों को विभिन्न पोंजी योजनाओं में निवेश करने के लिए प्रेरित किया था और उनसे प्राप्त धन को हड़प लिया था। उन्होंने कहा कि कुमार ने विभिन्न योजनाओं के तहत 500 से अधिक लोगों को करोड़ों रुपये की चपत लगाई है। उन्होंने पहले एक समिति का व्यवसाय शुरू किया जिसमें कई लोगों ने पैसा लगाया।

पुलिस अधिकारी की जानकारी के अनुसार, निवेशकों को प्रतिबद्धताओं के अनुसार पैसा वापस कर दिया गया था। अधिकारी ने कहा कि उनका विश्वास हासिल करने के बाद, उन्होंने ईनाम चिट और मनी सर्कुलेशन का व्यवसाय खोला और आकर्षक लाभ के साथ योजनाएं शुरू कीं। उन्होंने 100 सदस्यों के लिए एक योजना शुरू की, जिसमें प्रत्येक सदस्य ने रु। 5,000 निवेश किये। हर पांच महीने में एक लकी ड्रा खोला जाता था और विजेता को या तो नैनो कार या 1.2 लाख रुपये भेंट किए जाते थे।

उन्होंने 500 सदस्यों की एक और योजना शुरू की, जिसमें प्रत्येक सदस्य को इस योजना में रु 2,000 निवेश करने के लिए प्रोत्साहित किया गया, हर महीने लकी ड्रॉ खोला गया और विजेता को रु 50,000 रुपये भेंट किए जाते थे।

A Ponzi scam with incredible weekly returns

Another Ponzi scam has surfaced in the city with the arrest of a three member-gang which allegedly duped 2,500 investors to the tune of Rs 20 crore by promising high returns every week.

Police raided a hotel in UB City in central Bengaluru and arrested Sunil Kumar Choudhary, 36, of Haryana, Rijesh P, 36, and Rakesh K S, 41, both from Kannur. The police action came after Sanjeev Kumar Dana, 30, a private firm employee, lodged a complaint on September 2.

Police said that the trio had floated a fake investment company under the name of WAM Services. Their schemes ran like this: invest Rs 25,000, get Rs 1,250 per week for 20 weeks and the entire principal sum in the 21st week. Similarly, weekly returns of Rs 2,500 were promised on investments of Rs 50,000 and Rs 5,000 on Rs 1 lakh with a similar assurance of the principal repayment.

The police investigation found that the suspects were running nothing but a Ponzi scheme. They had returned only small sums to investors and splurged the rest. A senior police officer said the gang had lured many people in Kerala as well.

A court has remanded the suspects in police custody. Police are interrogating them about the extent of the scam and the number of investors.

The industry also creates many avenues for indirect employment alongside the income opportunities to direct sellers,. Usually MSMEs provide production, packaging, and logistics. Indirect employment in India’s direct selling industry today supports over one million people, in addition to a direct seller base of nearly four million. Indirect employment gives these businesses access to more revenue streams while the onus of working to international quality standards also enables them to create value through learning from the world’s best practices.

The industry also has its advantages from a customer perspective. Today’s retail consumers expect convenience, the best prices, and personalised interactions. While a majority of non-traditional channels meet some or all of these expectations, direct selling’s advantage lies in its personalized transactional experience. Direct sellers are encouraged to build authentic and trusting customer relationships that are beneficial in the long term. For buyers, this means an open and honest selling experience in the comfort of their home or workplace. Also, since direct sellers provide valuable first-person insights into consumer expectations, direct selling companies are quick to respond to market developments.

Consider the case of health and wellness. Consumers across social segments, income classes, and geographies are becoming more health conscious. They want better lifestyles, healthier work schedules, and access to world-class products. It’s no surprise that over 53 percent of direct selling product sells come from the health and wellness category. Relationships and product quality are always critical factors for retail success, and the direct selling industry is best placed to capitalise on this trend.

As India continues its rapid transformation, direct selling will be at the forefront of income generation and alternative means of employment in the retail space. A national retail policy that recognises and legitimises direct selling efforts with no room for confusion will be crucial for the industry’s accelerated growth. For direct selling companies, it will be important to create robust governance frameworks supported by standardised practices so that the sector can realise its true potential.
