The Neora Decision Reaffirms the FTC’s Authority

The Supreme Court’s judgment in AMG Capital barred the FTC from pursuing monetary remedies in court under Section 13 of the FTC Act (b). However, the recent Neora judgment indicates that the FTC has substantial power under Section 13(b) that may be utilized to inflict significant harm on direct sellers in court.

The court decided in Neora that the FTC can seek injunctive relief in court without first going through the lengthy and onerous administrative processes outlined in Section 5 of the FTC Act. In addition, the court decided that the FTC’s motion for injunctive relief would not be rejected since the complaint properly alleged that Neora “was violating or about to violate” the FTC Act.

This was true even though many of the charges stemmed from previous behavior, such as social media posts with potentially false income and product promises and a prior compensation plan with allegedly unlawful pyramid scheme features.

To summarise, AMG Capital did not render the FTC impotent, and direct sellers should continue to detect and correct red flag conduct that the FTC is searching for to avoid becoming an FTC target.

In Ecuador, The Mannatech Team Is Fighting Malnutrition

In late July, a group of Mannatech employees traveled to Ecuador to visit several Hope Zones with Kids Around the World and dedicate a beautiful playground for the local community.

The company’s humanitarian effort, Mission 5 Million Foundation (M5M), took part in Kids Around the World’s newest program, Generations Hope, thanks to funding from Mannatech. In just nine months, they’ve fed 800 Ecuadorian youngsters using Mannatech’s unique Phytoblend meal packet.

“A one-month supply of PhytoBlendTM powder is provided for every $100 bought on Mannatech products to help nourish a child in need,” stated Al Bala, President and Chief Executive Officer of Mannatech. “Through our relationship with Kids Around the World, we can make use of OneMeal, a mobile food-packing initiative that collaborates with volunteer groups to prepare meals for needy children. The OneMeal meal composition contains our PhytoBlend as a source of vitamins and minerals in every meal.”

Since 2009, the Mission 5 Million Foundation has provided over 122 million meals of nutritional support to malnourished children. Each year, the firm aims to provide more than 20 million nutritional assistance meals to malnourished youngsters.

Year-round, the Feed the Children x Avon Box is given to women and their families who are food insecure.

Since 2004, Avon has collaborated with Feed the Children.

The OPTAVIA Global Convention Raises $100,000 For Charitable Organizations

Last week, OPTAVIA held its annual OPTAVIA Convention in a unique hybrid style that featured both in-person and virtual guests. The worldwide event had over 15,000 registrations when combined with in-person visitors at the Georgia World Congress Center in Atlanta and the concurrent streaming experience.

“Our independent Coaches and Community were looking forward to the 2021 convention,” said Dan Chard, Chairman and Chief Executive Officer of Medifast. “As OPTAVIA expands its global reach, we continue to highlight the importance of community and support. We were happy to have this moment in time to celebrate our collective successes together and foresee how we might touch even more lives in the future after a year of uncertainty and social isolation.”

The OPTAVIA Community collected over $100,000 for organizations that support the company’s purpose of providing children with knowledge and access to resources that encourage healthy behaviors throughout the convention and through onsite contribution options. To date, the firm has helped to pay up to 8 million healthy meals for children who are hungry.

Changes to key leadership roles in Herbalife Nutrition’s Board of Directors have been announced

Three of Herbalife Nutrition’s leadership responsibilities will be rearranged and reassigned by the company’s Board of Directors. Alan W. LeFevre was just chosen as the board’s lead independent director. The compensation committee will be chaired by Maria Otero, who had been acting as the Board’s temporary lead independent director. The audit committee will now be chaired by Don Mulligan.

“We are thankful to Maria Otero for serving as both the lead independent director and the head of the compensation committee, and we look forward to her continuing contributions to Herbalife Nutrition,” said John Agwunobi, Chairman and CEO of Herbalife Nutrition. “Alan and Don bring a wealth of expertise and understanding in finance and consumer products to our Board of Directors, and we look forward to their advice as we build the groundwork for Herbalife Nutrition’s next phase of expansion.”

Since 2018, LeFevre has been a member of the Herbalife Nutrition Board of Directors, and he previously served as the chair of the audit committee. Mulligan was appointed to the Board of Directors in March 2021.
